The following notice is published pursuant to Section 95B(2) of the Commonwealth EPBC Act. AC Manager Pty Ltd is proposing to subdivide and develop a 41.48 hectare property, including construction of estate roads, subdivision of land parcels and development to create a residential estate at 78-88 Groves Road, Armstrong Creek, Victoria (EPBC 2022/09357).

The proposed action was referred to the Commonwealth Department of Climate Change, Energy, the Environment and Water to determine whether assessment and approval under the EPBC Act was required. On 23 December 2022, the proposed action was deemed a ‘controlled action’ under the EPBC Act subject to assessment by Preliminary Documentation. The controlling provisions are listed threatened species and communities (Section 18 and 18A).

Relevant matters of national environmental significance are habitat for the EPBC Act listed Growling Grass Frog Litoria raniformis. The draft preliminary documentation for the proposed action was published for public comment between 4 December 2023 and 15 December 2023, pursuant to Section 95A(3) of the EPBC Act. One public comment was received during the public comment period. The Final Preliminary Documentation has been finalised to respond to the public comment.

The Final Preliminary Documentation is now on display, free of charge between 24/01/2024 and 7/02/2024 at the following locations:
